Hi India,

If your landlord lives in Spain he will still need to be paying taxes to the UK so there will be a correspondence channel.  Have you tried contacting the landlord directly already?

Home Sweet home in Brighton did some good work and reported some landlords and agents to the authorities a couple of years ago. 
 
Generation Rent published a fee survey a few weeks go of verge letting gent fees around England if this is of any use.  alternatively you could try Open rent which cuts out letting agents.

Hi katya,

I'd take photos of as many things as you can. Did you take photos when you moved in?  The best thing to do is to raise a dispute as soon as you move out with the dispute resolution service of the deposit protection scheme you used. 

Was the deposit put in a scheme?  You should have had notice within 30 days of you moving in.  You should be quick though to do it because the arbitration/mediation sevice is only available for 3 months after you move out.  After that you'd have to go through the small claims process.

Agents are usually people who've failed in life and have zero talent.  In my last place the heating was completely inadequate for the size of the rooms.  It was just a small electric radiator in each room and half of them didn't work.  When they did they used loads of electricity without much producing much heat, which is weird because all electric processes generate heat. I mean my laptop generated more head than the heaters in the place and it was more economical.

Anyway, we complained about this over and over throughout the winter and they would send some chimp over once or twice, only after threatening them and not before. He drvoe a mini with the company emblem on the side but knew absolutely nothing about anything.  I later found out when I checked his name out on linkedin that he'd only done sport's studies at some rubbish university.  What a failure and completely wasting my time. 

Anyway.... enough agent bashing for today.

Hi

I checked the contract, it does have the landlord's address but he lives in Spain.  I guess that he left the day to day running of the place and the rent collection to the agency. 

I moved out a month ago and asked for the deposit back.   I phoned the agency but they didn't pick up my call and when I emailed them I got an automated reply to say that the agency had suspended trading.   Where do I go from here?

My husband died a couple of years ago leaving me and my daughter in a really bad position.  We couldn't afford to stay where we were living and had to ask for council housing. 

Anyway that was fine and I enrolled in an adult course at my local university in photography and I had some projects lined up in London after I graduated. 

The council transferred my property over to a housing association around christmas time and they said that I needed to move into a new place while they were doing renovation which I agreed to.  I moved into the new place and it was aweful.  There was damp everywhere and water dripping down from parts of the roof.  Slugs were all over the property and walles had been cut out with a saw and not fixed.  The place looked like a scene from the hostel films.  Anyway, I complained about the house the the council and they told me it wasn't their responsibility anymore and I had to speak to the housing association.  When I called them they said that they would look into it but after a week they did nothing.  I'm really worried about a fire because I think there are bare electrical wires.  Anyway I kept trying the housing association and they just said over the phone that they'll look into it and they do nothing.  This has gone on now for months and the only thing that has got better is the weather which as got rid of some of the damp problems. 

I'm really worried and this is affecting my studies and my daughter who is suffering at school because of it.  She's 15 now and I don't want it to affect her exams next year.

Please somebody, could you give me some help?  What are my options?

I would, I know of a few other people who've done it. I'm not sure if the landlord can check property records or council tax to see whether you really live there?

Hi

I've been living in a new flat in London for a couple of months now.  The place has no letting agent which I prefer and the landlord was really nice at first.  Last week though I had some friends over for a dinner party (just some fellow Aussies and some red wine and home cooked beef bouginion) and I though nothing of it, no rave and ket party until 5 am! 

Anyway the following day the landlord knocked on the door and asked how many friends I had over the previous night because in the contract only my boyfriend and I were allowed to stay and any guests had to pay £10 per head to the landlord for each day they stayed. I told him that my boyfriend would be back soon but I gave him £40 on the spot to get rid of him.  I checked the contract and he's right, it does say that I owe him £10 for each visitor.  I heard from somebody else who lives in the apartment building that he's really good friends with my neighbour and the neighbour gets a kickback for letting him know if anybody visits and that he did the same to the people who used to live there. 

I feel really bad and I don't know what to do, what are my options or do I just have to take it?

Hey India,

This happened to me a couple of years ago.  You need to take action quickly.  Have you moved out or are about to move out?  The money should have been put in one of the 3 deposit protection schemes and not kept by the agent.  You should have a receipt of the money being protected within 30 days of you moving in.  You'll need to double check that you got it and also just check what type of tenancy agreement you have.  Most people nowadays have a shorthold assured tenancy which is the one I'm most familiar with. 

Really get on this asap, you'll have more problems getting the money back if you wait.  If the money wasn't protected you can go after the agent or the landlord.  Just check this and keep us updated.

Hi Jeni

We have a pretty similar problem.  I grew up in a new build but have spent just over a year living in London in an old house too.  I never knew that there were so many sash window houses still standing.  The problem is that the houses are so old there are so many holes for the rats to get in that you'll constantly be battling to keep them out and getting paranoid about sealing them up. And it's amazing how small a hole rats and mice can crawl through, even the size of a one pence piece. 

If they are such a problem I'd push with the council. They'll also be able to send out an exterminator if you need one but often they're not the best.  Have you contacted the landlord directly or have you always gone through the agency?
